Standard Terms and Conditions for Consumer Purchases of Goods over the Internet

Introduction
This purchase is governed by the following standard terms and conditions for consumer purchases of goods over the Internet. Such purchases are primarily regulated by the Norwegian Contracts Act, Consumer Purchases Act, Marketing Control Act, Right of Withdrawal Act, and E-commerce Act. These laws provide the consumer with mandatory rights.
The laws are available at www.lovdata.no. The terms of this agreement shall not be interpreted as limiting statutory rights but define the main rights and obligations of the parties.
These terms are prepared and recommended by the Norwegian Consumer Authority.
1. The Agreement
The agreement consists of these terms and conditions, information provided in the ordering solution, and any separately agreed terms. In case of conflict, specifically agreed terms prevail unless they conflict with mandatory legislation.
The agreement is also supplemented by relevant statutory provisions governing consumer purchases.

Buyer:
The consumer placing the order, hereinafter referred to as the buyer.
3. Price
The stated price for the goods is the total price the buyer shall pay. This includes all taxes and charges. Any additional costs not disclosed prior to purchase shall not be borne by the buyer.
4. Conclusion of the Agreement
The agreement becomes binding once the buyer has submitted the order.
However, the agreement is not binding if there has been a clear typographical or pricing error that the other party understood or should have understood.
5. Payment
The seller may request payment when the goods are dispatched.
If payment is made by credit or debit card, the amount may be reserved at the time of order and charged upon shipment.
If payment is made by invoice, it will be issued upon shipment with a minimum payment deadline of 14 days.
Buyers under 18 years of age may not pay by invoice.
6. Delivery
Delivery is considered completed when the buyer or their representative has received the goods.
If no delivery time is specified, the goods shall be delivered without undue delay and no later than 30 days after the order.
7. Risk of the Goods
The risk transfers to the buyer once the goods have been delivered in accordance with section 6.
8. Right of Withdrawal
Unless exempt, the buyer has the right to withdraw from the purchase within 14 days in accordance with applicable law.
The buyer must notify the seller within 14 days. If the seller has not provided required information about the withdrawal right, the period may be extended up to 12 months.
The goods must be returned within 14 days after notification. The buyer bears the return costs unless otherwise agreed.
The seller must refund the purchase amount within 14 days after receiving notice, but may withhold payment until the goods are returned or proof of return is provided.
9. Delay or Non-delivery
If the seller fails to deliver on time and this is not due to the buyer, the buyer may:

terminate the agreement

claim compensation
10. Defects in the Goods
If the goods are defective, the buyer must notify the seller within a reasonable time. Notification within 2 months is always considered timely.
The complaint deadline is:

2 years for ordinary goods

5 years for goods intended to last longer
The buyer may demand repair, replacement, price reduction, termination, or compensation.
11. Seller’s Rights in Case of Buyer’s Breach
If the buyer fails to pay or fulfill obligations, the seller may:

withhold the goods

demand payment
-
terminate the agreement
-
claim compensation
The seller may also charge interest, collection fees, and reasonable fees for uncollected goods.
12. Guarantee
Any guarantee provided gives rights in addition to statutory rights and does not limit the buyer’s legal rights.
13. Personal Data
The seller is responsible for processing personal data. Data will only be collected and used as necessary to fulfill the agreement and in accordance with applicable privacy laws.
14. Dispute Resolution
Complaints should be directed to the seller within a reasonable time.
The parties shall attempt to resolve disputes amicably. If unsuccessful, the buyer may contact the Norwegian Consumer Council:
